How the Probate Process Works

When an individual dies with or without a will, the courts need to get involved. An executor, usually an immediate relative, is chosen to take charge of the decedent's estate. The executor gathers together the decedent's assets, notifies creditors, pays the bills, then distributes remaining assets to the heirs upon the court's approval. This process is called probating an estate and the rules are arcane and complicated.
